VACANCY: Three year professorship in international law with focus on international courts

The Faculty of Law, University of Copenhagen, is seeking applications for a three year appointment as professor of international law with focus on international courts and their impact on human rights. The position is to be filled as soon as possible.

The professor will be affiliated with iCourts - Danish National Research Foundation´s Centre of Excellence for International Courts, which is a research centre at the Faculty of Law. http://jura.ku.dk/icourts

The main responsibilities of the professor international law with focus on international courts and their impact on human rights are:
  • Develop the area of international courts and human rights at an international level by combining theoretical and conceptual development with in depth practical knowledge about the field.
  • Supervise PhD students on the basis of the above mentioned theoretical and practical skills.
  • Support the establishment of international networks of theorists and practitioners within the area of international courts and human rights.
  • Conduct teaching of students in international courts and human rights on the basis of theoretical and practical skills.
The professor shall also develop and maintain his or her teaching and pedagogic competencies. Other duties may be added according to Faculty regulations and the weighting of the different tasks may change over time.

SCHOLARSHIP: British Council Researcher Links initiative

The British Council is launching the British Council Researcher Links initiative, in partnership with various research and higher education organizations from around the world.

A 'call to action' was issued on June 12 for leading researchers to propose themes for bilateral workshops to be held in one of the partner countries (see below) that will bring together early career researchers to discuss their research and start to build international relationships. If you would like to propose a theme then we would encourage you to follow the steps outlined at the end of this page, before the application deadline of July 14.

The workshops may be specific to a particular field of research or interdisciplinary in nature. If the workshop is interdisciplinary, please indicate this on the application form by ticking more than one assessment panel as instructed. All fields of research are covered.

BOOK: Insights into Trusts Law: In the Channel Islands and beyond

The Institute of Law [- Jersey] has published Insights into Trusts Law: In the Channel Islands and beyond, a transcript of the proceedings of their conference in October 2012, edited by Scott Atkins, Senior Lecturer, University of Derby. The trust laws of the Channel Islands today stem from the new model trust law pioneered by Jersey in 1984.  This did not look at the trust through the prism of the (English) Trustee Acts 1893 and 1925, which are the models in many other trust law states.  Instead Jersey struck out on its own to produce legislation of a kind more suitable for an offshore finance centre in the late twentieth century, and in particular one whose customary law was rooted in the civil rather than the common law tradition. Of course the world has moved on since 1984.  Guernsey adopted a similar model within a few years, and since then their respective legislatures have played a friendly game of ‘improvement ping-pong’, each seeking to enhance their trust law offering to the domestic and international legal marketplace.

‘National constitutional identity’ has become the new ‘buzz word’ in European constitutionalism over the past few years. Much has been written about the concept involving the Member States’ national constitutional identities: it has been welcomed for (finally) accommodating constitutional particularities in EU law, demonised for potentially disintegrating the EU, and wielded as a ‘sword’ by certain constitutional courts. Scholars, judges and advocates general have rendered the concept currently so fashionable and yet so ambivalent that an in-depth analysis putting some order into the intense debate over constitutional identity is warranted.

This collection brings together a series of contributions from the perspective of both scholars and judges in order to shed some light into the dark corners of constitutional identity. To this end a threefold approach has been followed: a conceptual or philosophical approach, an approach based on EU law, and an analysis of the case-law of several European courts.

First the book explores what constitutional identity means and who decides on it. The next contributions analyse (and at times unveil) the areas that might collide or at least interact with constitutional identity. Among other issues the authors touch upon EU law primacy, Article 53 of the Charter of Fundamental Rights, EU criminal law and the essential functions of the State, and the existence of an EU ‘constitutional core’ enjoyable and enforceable through EU citizenship.


Finally, the chapters dealing with the case-law of European courts on national constitutional identity include the perspective of various national constitutional courts, such as those of Eastern and Central European Member States, the Court of Justice of the European Union, and the much less analysed European Court of Human Rights.

OVERVIEW: The International Society for the Reform of Criminal Law will be holding its 26th annual conference, International Responses to Social and Justice Challenges, in Hobart, Tasmania from August 15th – 19th this year.  As in past years the conference will provide an opportunity for updates on various international criminal proceedings and international cooperative development.  For the most part, however, the conference will look at a number of challenges that are confronting national, regional and international criminal justice institutions and governments on a variety of issues that are deeply grounded in the social fabric of societies. 


 This year’s conference will examine the challenges that vulnerable populations, particularly women and children, present as they come into contact with the criminal justice system as victims of violence and abuse, witnesses and as perpetrators of crime. Conference participants will also explore the relationships between mental illness and criminal behavior, including violence, and look at mentally ill people as victims of violence rather than just perpetrators. The conference will feature innovative and effective approaches for addressing the challenges associated with these populations from a criminal justice perspective.

 Another matter in question that has sparked emotional debate as countries increase their efforts to reduce crime is that of firearms legislation and control.  The conference will look at the desirability and effectiveness of firearm controls and legislation at the national level and explore the developments internationally to promote cooperation among States to prevent and eradicate the illegal manufacturing and trafficking in firearms.  

 Corruption is another complex social, political and economic phenomenon that affects all countries. Within the overarching theme of supporting international cooperation on all of the issues discussed the conference will look at the complexities of establishing viable anti-corruption regimes in view of the differing standards and processes that exist throughout nations.

 The conference will provide a forum for judges, prosecutors, policy-makers, representatives of law enforcement agencies and concerned citizens to discuss these challenges from a range of perspectives and try to establish how we can best formulate the criminal law and policy response to these difficult situations moving forward. The ISRCL anticipates a forward-looking conference that recognizes international perspectives on these important issues and contributes to the development of a fair, evidence-based criminal justice and security agenda.

REMINDER: Book proposals are being sought for the Juris Diversitas Book Series with Ashgate Publishing:
 

Rooted in comparative law, the ... Series focuses on the interdisciplinary study of legal and normative mixtures and movements. Our interest is in comparison broadly conceived, extending beyond law narrowly understood to related fields. Titles might be geographical or temporal comparisons. They could focus on theory and methodology, substantive law, or legal cultures. They could investigate official or unofficial ‘legalities’, past and present and around the world. And, to effectively cross spatial, temporal, and normative boundaries, inter- and multi-disciplinary research is particularly welcome.

Our first volume will be Seán Patrick Donlan and Lukas Heckerdon-Ursheler (eds), Concepts of law: comparative, jurisprudential, and social science perspectives.

While we anticipate publishing future collections (original, conference-based, Festschriften, etc), we're also very interested in publishing monographs and student texts.
